Apple Pulls Legal Crosshairs off Galaxy S III Mini

Riddle us this: Why file a patent claim against a device that isn't actually going to be sold in the jurisdiction ? let alone, the country ? of where you're filing the claim?

Such has been the peculiarity presented to Apple, which announced on Friday that it's no longer pursuing patent claims against Samsung's Galaxy S3 Mini smartphone. Samsung has said that it is not, "making, using, selling, offering to sell or importing the Galaxy S III Mini in the United States," and has maintained this stance ever since Apple asked a California court to add the device to Apple's latest patent dispute last month.

Apple won its first round of patent litigation against Samsung this past August, but that hardly put an end to the two companies' legal squabbles ? which includes Samsung's desire to lessen the approximately $1 billion in damages that it faces juxtaposed against Apple's interest in amending a second round of patent claims to add as many recently released and allegedly infringing Samsung devices as it can.

In other words, Apple's second patent infringement lawsuit includes devices (and claims) that the company didn't address in its first round of patent litigation. And Apple has been zealous about amending its filling to include more Samsung devices as warranted. Samsung, in turn, has been granted permission to add Apple's iPhone 5 to its own patent infringement claims. Both of these trials won't kick off until 2014.

Apple initially argued that its ability to purchase a Galaxy S3 Mini smartphone from Amazon, and have it billed and shipped to a U.S. address, was enough to qualify that the device was being sold in the U.S. And, as such, Apple argued that it should be allowed to include the smartphone as part of the list of current devices that Apple claims infringe its patents.

As part of Apple's withdrawal, the company indicated that it would do so, "so long as the current withdrawal will not prejudice Apple's ability later to accuse the Galaxy S III Mini if the factual circumstances change," as reported by Reuters.

Samsung launched the four-inch Galaxy S III Mini in Europe in November, which numerous pundits saw as a direct assault against Apple's similarly sized iPhone 5. At the time of Apple's request to add the Galaxy S III Mini to its lawsuit, there was plenty of talk that Samsung might bring the smartphone to U.S. markets ? which explains Apple's interest in bringing the full weight of its legal efforts to bear.

We recently had the chance to spend time with David Greaves and Vesa-Matti Hartikainen of Jolla and take Sailfish OS for a spin. As you might recall, this open source mobile OS builds upon Mer (a fork of MeeGo that includes Qt) and uses the Nemo framework with a custom UI. Like any decent Linux-based OS, it supports both ARM and x86 devices. The company is also behind the Sailfish SDK which is in the process of being finalized but is still open to developer feedback (the source code is available). After seeing Jolla's various demo videos and noting some UI similarities with MeeGo (swipes) and, strangely, with BB10 (peek gestures), we were eager to experience Sailfish OS for ourselves.

If you're wondering why the mobile OS is usually shown running on Nokia's N950 developer handset, that's because Jolla employs many ex-MeeGo engineers, so the OMAP-based phone was a natural fit. We were first given a walkthrough of Sailfish OS, then allowed to play with it. Many apps are still being worked on and some are still off-limits (we got in trouble for launching the camera), but what we saw was pretty solid. Josh Barro makes an important point: For Republicans, losing the political fight isn?t a downside of the strategy. It is the strategy.

Republicans are eventually going to have to agree to a compromise deal that is acceptable to a broad swath of Democrats and that substantially raises taxes. Their base is going to hate that. But if they drag their feet and get smacked around enough on the way to the deal, they will be able to sell the idea that they had no choice but to cave.

It?s very similar to the 2011 fight over the debt ceiling increase, which Republicans for a time insisted would have to be linked to congressional passage of a balanced budget amendment.

A good fight ? or at least the show of one ? placates the conservative base and helps Republicans avoid primary challenges. It also makes the Republican Party look incompetent and reckless, damaging the national brand. Indeed, Republicans actually lost the popular vote for House seats in November, though they held on to a House majority due to a favorable electoral map.

Barro points to California, where a small pool of very rich campaign donors funds a permanent cozy minority of obstructivist Republicans. They don?t get anything done, but their seats are safe.

Kicking and screaming and being unreasonable can help secure a cozy minority of legislative seats with a true-believing party base behind you. It?s a strategy that works. It?s just not a strategy that works for building electoral majorities.

Even NRO thinks??I?m alright, Jack? is?too selfish a strategy?for Republican politicians, ?rational for an individual but highly destructive for a political party? unless it truly wishes to be?a party of permanent and shrinking?minority. The problem, however, is that there?s no stick with which the G.O.P.s leadership can beat these recalcitrant, obstructivist seat-sitters into taking a more competitive line except to abandon them and try to make co-operative?deals with Dem Blue Dogs instead. That course will be the death of the current Republican Party.

Folks, I've been separated for nearly two months and I'm now working on self-improvement.

One area I identified that I need to work on is managing my anger.

My husband would bring out the monster in me. No, I would never throw things or hurt anyone in the process, but I'd drop a few F-bombs here and there and I'd certainly get LOUD.

Thing is, I generally don't have a temper. Most of my friends, even childhood friends, would be surprised if they were told that I have a temper. But I do.

People who know me too well and know how to push my buttons unleash that ugly side of me. My dad, my mom sometimes, and now my husband. I thought my temper problems were done with. That I was just an angry teen. That I'd overcome it. Apparently not.

Thing is, I'd been to individual counseling for an extended period of time before I got married. So I'm not sure that that's the route to go.

Does anyone recommend any self-help books or techniques to calm me down when I sense getting frustrated to the point of losing my cool?

Keep a record. Ask yourself at the end of each day "Did I remain centered today?" If you can answer 100% yes, mark that day a success. See for how many days you can maintain the streak, then aim to make the next streak longer.

I have a sibling though who could lose a lot of weight. The spouse of that sibling has tried everything from talking to getting their kids to talk about weight loss, but so far nothing has happened. The weight just seems to keep piling. You know that old saying "you can lead a horse to water, but you can't make it drink" ? Same thing applies. You can stock the house with healthy foods, model a healthy lifestyle, talk about clean eating and exercising until you're blue in the face, but you can't ever make someone who does not want to change, change. My sibling with the weight problem says it's not a bother and they're ok with it. I don't think so. I think it's just a facade, but there's nothing more any of us can do other than hope there's an epiphany or crisis (nothing too serious) that will snap them out of it.

The other thing you could do, if willing, is to draw a hard boundary. "I love you but your weight is making me lose attraction for you. If this continues..I will (insert consequence that you intend to follow through on, not just threaten)." There have been countless threads in the General Forum as well as the Men's Forum and Sex Forum on that topic alone so do a search.

Obama: Economy can't afford 'self-inflicted wound'

WASHINGTON (AP) ? President Barack Obama is urging Congress to reach a deal to avoid the fiscal cliff, saying the nation "can't afford a politically self-inflicted wound to our economy."

Obama says in Saturday's radio and Internet address that he believes leaders in Congress may be able to reach an agreement that can pass both houses before taxes rise and spending cuts take effect at the end of the year.

He urges "Washington politics" to not get in the way of "America's progress."

In the Republican address, Missouri Sen. Roy Blunt says "inaction shouldn't be an option" and the nation can avoid going over the fiscal cliff if Obama and the Democratic-controlled Senate work with Republicans to solve the problem.

gunmen3-300x168Some group of armed Teenagers shot dead a Maiduguri based merchant, Abubakar Girigiri, at his warehouse in the Bolori area of Maiduguri, Borno State on Thursday.

He allegedly died on the spot as he failed to make it to the hospital.

A witness, Modu Lawal told Journalists in Maiduguri that the gunmen arrived at the warehouse on foot, pretending to be customers before gunning him down.

Narrating the incident, the witness said ?A group of four teenagers arrived the warehouse on foot and met Girigiri, 58, attending to his business. After a short while, two of them brought out guns from their trousers and shot him at a close range?

The Police Public Relations Officer in Borno, Gideon Jibrin, confirmed the incident.

He also confirmed the killing of seven persons in Jere Local Government Area of the state by gunmen.

?The police is trying to get the full details of the report, so we can unravel the mystery behind the killings.?

Meanwhile, the Joint Task Force (JTF) on Operation Restore Order has also confirmed the killing of other three security men in the early hours of Thursday at the Ruwan Zafi area of Maiduguri.

The JTF Spokesman, Sagir Musa, in a statement in Maiduguri, said ?This is to confirm that three security men were killed in the early hours of the day by suspected members of the Boko Haram group. Efforts are on to apprehend the killers.?

You can edit existing ones or add your own, giving them a name, URL, and a keyword that you'll type to initiate the search (like the example of lh above. Firefox users just need to create a bookmark with the necessary name, URL, and keyword, and it'll work like a custom search engine when you type that keyword into your browser. I have found with Google, especially when I search for tech-related things (Linux), I get a lot of out-of-date results. If I am searching to see if someone else is having trouble with CUPS, I don't care what was happening in Ubuntu 11.04. So, I added this as my default search in Chrome:

It searches for results in the past year, giving me recent, relevant results.

You can do this with any time frame you want, like one month, two month, or two years, as we've noted before.

Search Wikipedia for TV Episodes or Music Albums

Give it a keyword (like ep), then just type ep doctor who in your address bar to get a list of Doctor Who episodes right away.

Okay the TV show trick just blew my mind. This is probably 20% of my Wikipedia searches. I tried this:

And sure enough, this works for a list of a bands albums. Oh man, I am going to have fun with this.

You could adapt any other "series" of pages on Wikipedia with this same concept, which could be all sorts of useful.

Get Driving Directions to an Address

Replace my+home+address with your actual home (or work, or whatever) address. Give it a keyword like maps, then type maps 123 main street in your address bar to get immediate directions to 123 Main Street.

Search Whatever Site You're Currently Viewing

Instead of setting up a custom site search for that blog right then and there, you can use a custom search engine that just searches your current domain:

Most of the above searches use clever URL tricks that you might not have thought of yourself. However, it's also worth mentioning that you can still use this for just plain searching on any site you want: IMDB, YouTube, Wikipedia, Lifehacker, or anything else you can think of. Translate words: A few of you mentioned using Google Translate, which is great if you're learning a new language. To do so, create a search with the URL:

This translates a word in another language to English, though you can tweak the auto|en part to fit whatever you want.

Use "I'm Feeling Lucky" on Google: If you know your search term will reveal a certain page, Google's "I'm Feeling Lucky" is useful to have as a keyword. Just use this URL:

I tweaked the javascript search from the "Search Current Domain" engine above to work for Down For Everyone Or Just Me:

If you use that, you can use it right after you visit the site. Say you visit Lifehacker and its down. You can just go to the address bar, type your keyword, and press Enter. Your browser will search for the current domain on Down For Everyone or Just Me so you can see whether the site's having problems.


Okay, so that probably ended up being a bit more than five, but these five general ideas can spawn all kinds of awesome uses for this feature. There are a ton of other great ideas out there, too?these are just a few of the best you guys shared with us.
